Terms of service

Services are provided by Future Point Software LLC ("we") to business customers on a weekly subscription basis. Fees are invoiced in advance and due within 14 days. Either party may terminate at the end of any billing week with written notice. We provide the service with reasonable skill and care; our aggregate liability is limited to the fees paid in the twelve months preceding a claim. These terms are governed by the laws of the State of New Mexico, USA.

• Service. Future Point provides software and related services to business customers for the management of marketplace listings, prices, stock, orders and shipments. The customer remains the sole operator of its seller accounts and is responsible for its listings, prices, products and compliance with each marketplace's rules.
• Accounts and credentials. The customer authorises Future Point to connect to its seller and supplier accounts. Credentials are stored encrypted and used only to provide the service. The customer may revoke access at any time.
• Fees. Plans are billed weekly in advance, in US dollars unless agreed otherwise. Nothing is billed before the workspace is live. Either party may end the service at the end of any billing week.
• Availability. We aim for continuous availability and publish our uptime. Scheduled maintenance is announced in advance. Service level commitments, where applicable, are those stated in the customer's plan.
• Acceptable use. The service may not be used to infringe intellectual property, to sell prohibited goods, or in breach of a marketplace's or supplier's terms. We may suspend a workspace that puts other customers or the platform at risk.
• Liability. We provide the service with reasonable skill and care. Our aggregate liability is limited to the fees paid in the twelve months preceding a claim. We are not liable for marketplace decisions, supplier failures or lost profits.
• Data. Customer data remains the customer's property and can be exported at any time. On termination, data is deleted within 30 days unless retention is required by law.
• Law. These terms are governed by the laws of the State of New Mexico, United States. Disputes are submitted to the courts of Bernalillo County, New Mexico, unless mandatory law provides otherwise.
